Chief Justice of Pakistan, Qazi Faez Isa, has officially called upon the chief justices of the country’s high courts to initiate the nomination process for additional judges. This call comes as part of his efforts to address the judicial vacancies and ensure the effective functioning of the judiciary across Pakistan.

In a detailed letter dated August 28, 2024, Justice Isa emphasized the critical need to fill existing vacancies within the judicial system. He highlighted that an adequately staffed judiciary is essential for the smooth and efficient operation of the courts, ensuring timely justice for all citizens.

Chief Justice Isa pointed out that the Supreme Court of Pakistan, which comprises sixteen judges, including himself, resumed its full operational capacity on June 25, 2024, after a period of two and a half years. This marks a significant development in the country’s judicial landscape, as the Supreme Court had previously been functioning with a reduced number of judges due to various reasons.

In addition to this, the Shariat Appellate Bench, which plays a vital role in addressing cases related to Islamic law, also became fully functional again following the appointment of a second aalim member in July 2024. This reconstitution of the bench was another step towards strengthening the judiciary’s ability to handle a diverse range of legal issues effectively.

Justice Isa’s letter underscores the importance of transparency and adherence to democratic principles in the process of nominating new judges. He urged the high courts to carefully consider suitable candidates for judicial appointments, ensuring that the selection process is conducted in a fair and transparent manner. This call aligns with the principles outlined in the rules of the Judicial Commission of Pakistan (JCP), which were established in 2010 to enhance the transparency of the judicial nomination process.

Justice Isa also mentioned that a committee had already proposed amendments to the existing JCP rules. These proposed changes are currently under discussion, reflecting ongoing efforts to refine and improve the judicial nomination process. The Chief Justice’s call for expedited nominations is in line with these ongoing discussions and aims to address the pressing need for judicial appointments.

He specifically requested that all potential candidates be considered promptly, particularly in instances where there are more than five vacancies. This request is aimed at ensuring that the nomination process is conducted efficiently, allowing for proper deliberation and the selection of the most qualified individuals for judicial positions.

The emphasis on filling judicial vacancies promptly and transparently is part of Chief Justice Isa’s broader commitment to enhancing the effectiveness and integrity of Pakistan’s judicial system.
